    First thing, the Senate would have to be tied 50/50 for her to break the tie. I'm not sure she can garner that much support. I'm beginning to think Manchin and Sinema are going to be big factors if Biden gives her the nod.

    I read the same article Bubba, but it did not for certain say either way about her validity to do so. Unless I misread it, I was of the assumption it stated the issue was covered Constitutionally, but also said that it has been accepted on some occasions........anyway.     Biden has vowed to "nominate" a black, female justice, regardless of qualifications, to SCOTUS.
    They "know" the GOP will vote against ANY liberal. If that nominee just happens to be black AND female....they will throw out that (R)'s are "racist" and "misogynistic"!

    BTY, if these Judges are suppose to follow the law and constitution, why does it matter what color they are. Answer: they, especially the blacks have agenda's and they vote as blocks.

    They are called 'Social Constructionists',, a small, minority that believes what has been for Centuries DOES NOT have to be in the future. The whims of Society can morph into a form of a new NORM, and Courts can abd do facilitate it. . CRT, Equity, LGBTQUEER and all that is a trending new normal - ONLY if the 85% remainder of Society allows it
