Here's another one jimbo!
Harvard Law professor Noah Feldman states that until Pelosi sends the "articles of impeachment" to the Senate, Trump "is not" impeached!
"... Originally posted by 99explorerView Post

Seems according to Prof. Feldman, 99explorer just got kicked in the cajones!

It was a strictly legal proceeding (with political overtones).
The subpoenas were not enforced in the courts because of time constraints, but defiance of the subpoenas became the second article of impeachment (obstructions of justice).

BTW, Lawrence Tribe of Harvard is the one who has laid out the entire impeachment protocol for Pelosi. And more slime comes out of Harvard.
Basically, the (D) minority in the Senate dictating how the majority (R)'s can conduct the trial, or insuring the best shot at removing Trump.
Schumer is telling McConnell he can't call Schiff, Nadler, the whistle blower, etc, etc, and the (D)'s can call Mulvaney, Pence, Pompeo, Giuliani, etc, etc, and restrict the questions the (R)'s can ask!
In other words, another kangaroo court!
....and I believe you're exactly right.
McConnell doesn't need the House to "forward" the articles, he can proceed without them.
He can also block any (D) objections like Schiff and Nadler did.

Neither Nadler nor Schiff held "legal" proceedings. Had they been legal, they could have forced the subpoenas and the documents.
That's why this "impeachment" is political, not legal.

I think Trump should be accorded the same rights as the accused Salem witches.
He should be dunked under water for ten minutes, and if he drowns, it will prove his innocence.
If he survives, it will prove his guilt, and he should be burned at the stake:-))

The fact that Schiff's investigation was a "political ploy" instead of a "legal proceeding", there was no legal precedent for Trump to submit records or personnel to the proceedings, which is pretty good testimony to liberal intellect.
On top of that, now Pelosi doesn't want to send the articles of impeachment to the Senate.
Pelosi and Schumer want McConnell to let "them" conduct the trial!!!
I thought the Senate and the House were separate entities?

The major evangelical magazine, Christianity Today, founded by Pat Robertson has come out calling for impeachment just as they did with Clinton. I mean it's obvious that all those senators and congresspeople heard the same testimony. They all know what's up. I guess I'm just as guilty of wanting Trump to stay in office because he will push issues I care about and I mostly ignore how whacky he is.
Pelosi is certainly right to withhold a propaganda show. The Republicans have had plenty of time to submit any sort of alternate facts, and all they want to do is spew unsubstantiated debunked anti Biden theories on national television instead of investigating Trump's self admitted malfeasance. All they'd have to do is call Bolton and others to testify who were present during most of the conversations. The fact that Trump has turned over none of the records requests and allowed no white house officials to testify speaks for itself. Eventually Pelosi will come up with some very reasonable suggestions, then McConnel can refuse them and Republican senators can field questions about why they won't hold hearings. Trump has already been impeached.

It appears the founding fathers anticipated a rogue president, but not a rogue senate leader from the same party at the same time.

The GOP has a problem.
McConnell wants a brief trial and a quick vote of acquittal.
Trump wants a show trial where he can call witnesses like Joe Biden and son, so he can have them raked over the coals.
Maybe also Geo. W. Bush and Barack Obama, but not himself or anyone from the White House.

If Pelosi never sends the articles of impeachment to the senate, Trump will become the only president to be impeached, but not acquitted in the senate.
