  • Gun Laws Dem's propose

Attorney Ryan Clcekner is a former Ranger Sniper and a pro firearm attorney. He appeared on the Tucker Carlson TV show and has some interesting ideas about Dem's proposed legislation - which won't work. Here is what he says gun owners should do.

jimbo, this is no different than you wanting the ID of gun show buyers/sellers and/or having some LEO check a DL# or gun serial number.

I'm not sure what your saying bubba. If you purchase out of state a backround check is already required. What it comes down to is the laws we have don't work. Maybe they need to look at something other than gun laws like mental health. The dems will never see it though

For particulars about a gun control measure that has worked well because it was directed at criminals, see

Why don't we hear more about this type of Legislation ?? You should post a brief synopsis of the law and not just a link - a lot of people would never open the link. Jim

I think one of the main reasons for its success is that it was widely publicized on billboards, buses and TV ads that educated the criminals to the consequences of being caught with a gun in their possession: Five years in a federal penitentiary far from home!

JT, this is in reference to nonlicensed gun buyers/sellers, whether at a gun show or by private treaty, who ask for and record a buyers/sellers ID# (drivers license) or have a LEO buddy run a check on the serial number of a gun they have purchased.

It is an invasion of your privacy to ask for your DL unless required by law.
It is illegal for a LEO to access a "LETS" computer except in the line of duty. i.e. writing a traffic ticket or investigating a crime.

It is strange, but even a program as this, which is directed straight at the criminal aspects, has it’s detractors ! If you read the “Oppositions” it is noted that even pro gun groups, for whatever reasons, objected to this law. It just points out the difficulties of satisfying everyone when it comes to gun control, even when laws are implemented only against criminals alone. It makes no sense !
Note: this was to be posted under post #4 (Project Exile) by 99.

You don't hear more about it because states are reluctant to cede any "power" to the federal gov't.

As "State's Rights" go, states have gone above and beyond the true meaning of the 2A.

This is another example of liberal laws that restrict Constitutional rights. Regardless of the law being "unConstitutional", because it was passed and enforced, it is now a "precedent" and cannot be reversed.

Laws may be passed and enforced, but that does not mean they cannot be reversed because of "precedent."
Abortion was a crime in many states before Roe v. Wade.

If a statute is poorly drafted, and there are questions about its applicability to certain situations, it may require a court to determine the legislative intent.
That interpretation becomes the precedent, which must be followed by equal and lower courts in the same jurisdiction.
Then, if a higher court changes the interpretation, that ruling becomes the new precedent.

Maybe I should have said, "probably won't be reversed."
...but the fact remains 99, with courts like the Ninth "Circus", liberal "precedents" are quite often upheld.

The Ninth Circuit Court recently overturned its own ruling on the same case.
A three-judge panel of the Ninth Circuit initially ruled that a Calif. city "shall issue" a carry permit without a show of necessity.
Then, on petition by the city, an eleven-judge panel of the same Ninth Circuit court ruled in favor of the city. (Peruta v. San Diego).
The U.S. Supreme Court declined to hear the appeal.

If a prospective purchaser does not show me a drivers license, guess what, they don't get the firearm. Period.
